Apple Express Rewards Program Terms of Service and Privacy Policy. These terms of service and privacy policy (“Agreement”) is between you and Apple Express, Inc. (“we” or “Apple Express”). You accept the terms and conditions of this Agreement when you sign up for the Apple Express Rewards Program (“Program”) or when you redeem your points. Purpose. The purpose of the Program is to reward Apple Express customers for placing logistics orders. How the Program works. You accumulate points when you schedule your logistics through us. The number of points awarded is based upon the volume of shipments. The points are credited to your personal account only after we receive full payment for the shipment. Points are redeemable for select merchandise offered by us. Eligibility requirements. Only individual full-time employees or the owners of Apple Express customers may participate. You may participate only if participation is not restricted or prohibited by your company. You must be the person, or one of the persons, who directly does business with us on behalf of your employer or company. Registration process. To register, you must log onto our website and provide us with 1) your name, 2) your email address, and 3) the name of your employer or, if you are the owner, the name of your company. Upon completion of your registration, we will verify the information and you will be asked to provide a user name and password. Accuracy of Your Information. It is your responsibility to ensure the accuracy and completeness of the information you enter. If you do not enter complete and accurate information, we might not be able to provide you with the information you seek or fulfill your reward. APPLE EXPRESS IS NOT RESPONSIBLE FOR CONTACTING YOU IF THE EMAIL ADDRESS YOU ENTER IS NOT ACCURATE. You represent and warrant that all the information you provide to us is true and accurate. Other Information Received. In addition to the information you enter on the website, we receive, analyze, and store certain types of information whenever you interact with the website, whether or not you have agreed to this Agreement. For example, we may collect the IP address used to connect your computer to the Internet, your email address, information about your browser and operating system, the Uniform Resource Locators (URLs) of the websites you visit before and after our website, and information about how you move around our website. We may place cookies on your computer to prevent fraud, to personalize your experience on our website, and to collect and store this information so we can improve our services and the Program. A cookie is a small piece of information that a website can send to your browser and may then be stored on your computer’s hard drive. You may be able to block, delete, or disable cookies, but doing so may prevent you from taking advantage of some or all of the Services. How Apple Express Shares the Information It Receives With Authorized Third Party Service Providers: We have agreements with other companies and individuals to perform functions on our behalf (“Third Party Service Providers”), such as providing marketing assistance, operating or hosting our website, sending your awards to you, and analyzing data with Google Analytics. We may share your personally identifiable information with these parties so they can provide the services that we have contracted with them to provide. We encourage these Third Party Service Providers to adopt and post privacy policies; however, the use of your personally identifiable information by such parties is subject to their privacy policies and is not subject to our control. With Our Advertisers: We may share de-identified, aggregated information about you with companies that wish to advertise on our website. While Apple Express will not send you third party advertisements, advertisers with whose ads you interact on our website may send you advertisements. You may obtain information about Internet advertising companies, including how to opt out of their information collection, by contacting the Networking Advertising Initiative at http://www.networkadvertising.org/managing/opt_out.asp. For Apple Express’s Protection or the Protection of Others: We may disclose your personally identifiable information if we believe in good faith that such disclosure is necessary to comply with the law or a court order, enforce this Agreement, or protect the rights, property, or safety of Apple Express or others. Access to website. You are responsible for obtaining and maintaining all Internet connections, computer software, and hardware needed to access and use our website. You acknowledge that sometimes there are interruptions in Internet service that are beyond our control and APPLE EXPRESS shall not be responsible for any data lost during Internet transmissions. While we intend to make our website accessible 24 hours per day, 7 days per week, you acknowledge that our website may be interrupted or suspended from time to time for any or no reason. We are not responsible for your inability to access our website. How points are awarded. After you place an order with us on behalf of your employer or company, you must log onto our website using your user name and password. You will provide us with the purchase order number for the shipment, including the date of shipment, origin, and destination. When we receive payment on the invoice, we will add the appropriate number of points to your Program account. Only one registered employee or owner may claim points for any one shipment, although more than one individual from a given Apple Express customer may participate in the Program. The accumulation of points is subject to the terms of this Agreement, which may be modified by us at any time. You can view your total points by logging onto your account. How you redeem your points. Only you may redeem your points. We post reward merchandise on our website along with the number of points required for the particular merchandise. The merchandise we offer may change from time to time, with some merchandise being added and other merchandise being deleted. As a result, the merchandise you might want to claim may not be available at any given point in time. All of the merchandise is provided via a third party. The description of the merchandise is provided to us by the third party and we do not guarantee that the descriptions are error free. The third party will ship the merchandise directly to you. The risk of damage or loss after you redeem your points is with you. Once you redeem your points, the transaction is final and you may not return the merchandise to us for any credit. No liability for merchandise. We offer merchandise that we believe may interest you. We make no representation or warranty regarding the merchandise itself and specifically disclaim any liability for any injury, death, or economic loss suffered by you or third parties from the merchandise. Cancellation of membership. Your membership in the Program will be cancelled and you will not be able to redeem your points if: Your employment with your employer is terminated. Your employer adopts a policy that directly or indirectly restricts participation in the Program. You commit fraud or make a material representation to us. A change in law or regulations prohibits continuation of the Program or your participation in the Program. Modification/Termination of Program. We reserve the right to modify the Program at any time, including the right to increase the number of points required for merchandise, or to terminate the Program. If we modify the Program, you agree to be bound by the new terms. If we terminate the Program, you will have 30 days from the date we announce termination for you to redeem your points. Any such announcement will be sent to the email address you provide to us when you register. Limitation on damages. You are solely responsible for keeping your user name and password confidential and secure. If you provide your user name and password to another person, we will not be liable for any points redeemed by the unauthorized user. Limitation on liability. You agree to release us, our affiliates, officers, directors, employees, and agents from any cause of action or claim regarding your participation in the Program, including how points are credited to you, the merchandise available to you for redemption, the method of redemption, the forfeiture of your points, or the cancellation of the Program. You agree to release us from any claim for damage, injury, or death as a result of your use of any merchandise redeemed by you. Indemnity. You agree to indemnify and hold harmless us, our affiliates, officers, directors, employees, and agents from any and all loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) arising from our or your participation in the Program; any fraud, misuse, or abuse of the Program; violation of this Agreement or your employer’s rules and regulations; and/or violation of any applicable law or the rights of any third party. No cash value. The points have no cash value. You have no property rights in the points. While the merchandise available for redemption might include gift cards issued by a third party, the points are not gift card nor credit cards. No transfer. You may not transfer your points to another person or third party. Void where prohibited by law. The Program is void where prohibited by federal, state, or local law or regulations. Communications with you. By enrolling in the Program, you agree that we may send you emails regarding the Program and the services we offer. You may opt out of receiving our emails at any time, but if you do so, you may not receive updated information regarding the Program. Law and dispute resolution. This Agreement is governed by the laws of the State of Illinois without reference to its conflict of laws provisions. In the event that there is any dispute between you and us regarding the Program or any merchandise received, you agree that the dispute will be submitted to a mediator located in Cook County, Illinois, and that the decision of the mediator is final.
